Although not all that exists is human, stones and animals aren’t, everything that we know that exists or has been ever made or is even missed or merely imagined is human. Things and notions, whether they have a physical subtract or not are entirely represented by the language crafted by humankind. Thousands of words distilled throughout centuries, contained and classified in dictionaries, regardless of the diverse idioms, constitute the language with which we bridge the self-contained consciences of millions of individuals in order to protect and grow in our commonality, within and through communication, oral, written or figurative. Hence, everything from words and numbers had a human beginning it comes from someone’s initiative an individual whose decision and action admitted by other or others was then successfully taken and carried forward in time by the initiative or initiatives of fellow humans.
Philosophy, science, grammar, technolgy, crafts, religions, the invention of letters, alphabets, words and definitions, numbers, the realization of time, distance, mass, energy, substance, and their metric units, the understanding of matter in the astronomical molecular, atomic and subatomic scale and explanations of human transcendence before life and after death, all ideas and inventions source from human action and a preceding initiative. Without freedom to do so, without a compass of action for the emergence and deployment of the initiative to enterprise, to reform, to agree, to disagree, to learn, to move, to love, to inform, to counsel, to lead, to follow, to create, to help, to change, to express, to associate[i], to pray, to invest, to give, to rest and to grow, the chance for personal self-realisation and social progress are lost. Whether it is deployed in a singular or plural mode, human initiative needs to be protected from undue restriction or instrumental capture of the value it creates in society and promoted in a free exchange dynamic of ideas, goods and services. A free marketplace to access and use by all and any member of the public acting solely or collectively is as important to defend as it is to safekeep their freedom of initiative.
Protecting the initiatives of human beings without consideration to the vast array of racial, sexual, economic, ethnical or ideological variations amongst them, is what is what human rights do. Stemming from the unified concern for human dignity and freedom of all people, for ease of understanding, empowerment and respect of the rights-based side of law, of the juridical protection to an individual’s voice and agency, human rights have been categorised as those sheltering the civil and political initiatives of human beings in one hand, and those sheltering the economic social and cultural initiatives of the people on the other. The idea of a fundamental right to human life and initiative is a recent conquest of civilization. Advanced by intellectual shifts, revolutions, revolts and reforms chiefly since the 17th century, it was agreed upon very recently in 1948 though the universal declaration of human rights.
Both rule making and business making are limited by the fundamental rights of the human collective. Ideological, industrial, religious and commercial forces, of either a local or foreign origin, constantly seeking, to shape and reshape institutions and influence the drafting of the rules of the game of society, have started to be reined in.
The idea of a bottom-up decision-making force from the people and furthermore the right of all humans to enjoy equally a right to remain alive and enjoy a reasonable marge of initiative for personal autonomy and development is now imbedded in the constitutional documents of the modern nation-states and reinforced by international pacts and treaties.
Shifting from government to self-government, and from a rule-enforcement-approach only to a rights-based approach to law also, is neither a fast nor an easy process. Safekeeping and advancing this new approach of law in civilization is the daily task of the human and civil society. The temptation of l powerholders and power players to restrict the agency and voice of opposition, competitors or nonbelievers is big and the risks of falling into the excesses of tyranny, monopoly, monopsony, despotism and fanaticism a constant.
The challenge of protecting human initiative is to be met with prudence also as bottom up diverse and popular participation and rights based empowerment that fails to be transparent, pertinent and structured can hinder technical objective coordinating and harmonised law making and effective government and with it societal organisation and collective development.
